Houses on edge of south Devon town

    An outline planning application for thirty two houses with significant local highway improvements was recommended for approval by officers but refused by the Planning Committee.  The application was refused on highway safety grounds only. The committee members were advised by their highway experts that there was no technical reason to refuse the application, but they did so anyway!

    The appeal required detailed analysis of the local plan situation with a robust defence based upon the technical highway matters. The appeal was allowed and the Inspector considered that the committee had acted unreasonably in ignoring their officers’ advice. As a result, a full award of costs was awarded to my client by the Inspector.
